The FRA does not explicitly ban lap-seam boilers and as such #6 could _theortically_ operate under FRA regs. However, the FRA requires the equivalent of 1472 day inspection on lap seam boilers every year, rather than every 1472 days or 15 years as with but seam boilers. This makes a lap-seam boiler impractical to operate without a succesful waiver. In any event, #6 was not under FRA rules but Indiana state boiler code at the time that the state code was changed to outlaw lap seam boilers. This was after #6 was disasssembled for an overhaul. This is why she was not put back together.

The only surviving East Broad Top locomotive which is not sitting on the EBT property has a lap seam boiler. Such a boiler is a major no no in the eyes of the FRA. For this reason, she will probably never run again (would need a new boiler or very special circumstance). She was of an outdated design when new in 1907. In the past, attempts have been made to repatriate her to Pennsylvania, but without success.

EBT No.6 has not been operational for quite some time from what I have heard. The locomotive is stored, unserviceable.
